Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ASO Sensor website, applications, and related services (collectively, the “Service”), operated by VASUNDHARA SOLUTIONS LAB LLP (“ASO Sensor”, “we”, “us”, “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 18 years old and able to form a binding contract under applicable law to use ASO Sensor. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, and “you” refers to both you and that entity.

To use most features of the Service, you need an account. You are responsible for:

• Providing accurate and complete information when you register.
• Maintaining the security of your credentials.
• All activity that occurs under your account.
• Notifying us promptly at [email protected] if you suspect unauthorized access.

ASO Sensor helps app teams track keyword rankings, monitor competitors, record store listing changes and measure their impact on the App Store and Google Play, and suggests what to try next. The Service is intended for legitimate use by developers, publishers and agencies who have lawful access to, and authority to manage, the store accounts and apps they connect.

The Service is available to all eligible users. We offer a free Starter plan, and paid plans as they become available. Plan features, limits and availability are described on our pricing page and in the dashboard. We reserve the right to:

• Modify, pause, or limit the Service with reasonable prior notice where practicable.
• Adjust plan limits or pricing, with advance notice to affected account holders.
• Suspend or remove access for violations of these Terms or applicable law.

You agree not to:

• Use the Service in violation of any law, regulation, or Apple's or Google's developer policies and agreements.
• Use the Service to manipulate app store rankings, ratings, reviews, or search results through fraudulent or deceptive means.
• Attempt to reverse engineer, decompile, disassemble, or extract source code or underlying ideas from the Service, except to the extent that applicable law expressly permits.
• Interfere with, probe, or disrupt the Service, our infrastructure, or other users.
• Use automated means to access or extract data from the Service other than through APIs, exports and integrations we explicitly support.
• Resell, sublicense, or commercially redistribute the Service without our prior written permission.
• Connect store accounts or apps that you do not own or are not authorized to manage.

You retain ownership of the data you provide to ASO Sensor, including data retrieved from your connected store accounts, the keywords and competitors you track, and the notes and decisions you record (collectively, “Your Content”). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit Your Content solely as needed to operate and improve the Service for you.

You are responsible for ensuring that you have the rights and authority necessary to submit Your Content to the Service.

The Service, including its software, user interfaces, designs, documentation, logos, and other content (excluding Your Content), is owned by ASO Sensor or its licensors and is protected by copyright, trademark, and other intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service.

Apple and Google alone decide how apps rank, appear in search, and perform in their stores. ASO Sensor helps you understand changes and suggests what to try next, but does not guarantee any ranking, visibility, download, or revenue result. You acknowledge that:

• Rankings, search results, and other store data can be estimated, delayed, or incomplete, and may differ from what you see in the stores.
• Apple and Google may change their stores, ranking systems, APIs, or data formats at any time.
• Recommendations are suggestions; you decide what to change in your listings and are responsible for those changes.
• Past performance does not guarantee future results.

ASO Sensor offers a free Starter plan. Paid plans are described on our pricing page at asosensor.com as they become available, and their pricing is incorporated into these Terms by reference. Paid plans are billed in advance on a monthly or annual cycle, in the currency shown at checkout, and payments are processed by our third-party payment provider. You can manage or cancel your plan at any time from your billing settings.

We may adjust pricing for paid plans with advance notice to affected account holders. You are responsible for any taxes associated with your use of paid plans (such as GST or VAT), other than taxes based on our net income. Fees already paid are non-refundable, except as set out in our Refund & Cancellation Policy or where required by applicable law.

The Service interoperates with and relies on third-party platforms, most notably Apple's App Store Connect and Apple Ads and Google Play Console, as well as our payment provider. Your use of those services is governed by their own terms and policies. ASO Sensor is not responsible for third-party services, their availability, or their decisions.

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY ERRORS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ASO SENSOR, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO ASO SENSOR IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

You agree to defend, indemnify, and hold harmless ASO Sensor and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or third-party right, or Your Content.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, abuse the Service, pose a security risk, fail to pay applicable fees, or for any other reason with reasonable prior notice where practicable. Upon termination, your right to access the Service ends immediately, and we may delete account data in accordance with our Privacy Policy and our retention obligations.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. The courts at Surat, Gujarat, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. We will post the updated version with a new “Last updated” date. Material changes will be communicated to account holders by email or through the dashboard before they take effect. Your continued use of the Service after the effective date of an update constitutes acceptance of the updated Terms.

These Terms constitute the entire agreement between you and ASO Sensor regarding the Service and supersede any prior agreements on the same subject matter. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
